Traveller Declaration & Precontractual Information

The traveller declares to have received and examined the catalogue, the non-standard itinerary or customised trip relating to the package covered by this offer, to be familiar with and expressly accept the general conditions, information sheet and fees indicated therein, and to acknowledge that the contract shall be deemed concluded upon acceptance by the Provider.

The traveller also declares to have received in writing the pre-contractual information pursuant to Article 34 of the Italian Tourism Code, unless expressly waived.

Pre-Contractual Information

The combination of travel services offered constitutes a package pursuant to EU Directive 2015/2302, implemented in Italy by Legislative Decree 62/2018, amending Articles 32–50 of Legislative Decree 79/2011 (Italian Tourism Code).

The organiser and seller of the package is Agency Viaggi dell’Elefante S.r.l., with registered office in Via D’Ascanio 8, 00186 Rome, Italy, which is fully responsible for the correct performance of the package pursuant to Article 42 of the Italian Tourism Code.

The organiser is duly authorised and insured for civil liability and insolvency protection, including repatriation guarantees as required by law.

Fundamental Rights under EU Directive 2015/2302

Travellers are entitled to receive all essential information before the conclusion of the contract and benefit from EU rights applicable to package holidays, including assistance, transfer rights, price protection, termination rights, refunds, compensation and insolvency protection.

General Terms and Conditions of the Package Travel Contract

Content of the Package Travel Contract

The contract includes these general terms and conditions together with the description of the package holiday, booking confirmation and documents referred to in Article 36 of the Italian Tourism Code. By signing the proposal, the traveller declares acceptance for themselves and other beneficiaries.

1. Regulatory Sources

The sale of package holidays is governed by Articles 32–51 of Legislative Decree 79/2011 (Italian Tourism Code), as amended by Legislative Decree 62/2018 implementing EU Directive 2015/2302, as well as applicable provisions of the Civil Code and the Italian Navigation Code.

2. Governing System

The organiser and seller must be duly authorised under applicable legislation and insured against civil liability and insolvency risks. The use of professional titles is permitted only to authorised entities.

3. Definitions

Traveller means any person entitled to travel under a package travel contract. Professional means any entity acting as organiser, seller or service provider. Organiser-Seller means the professional who arranges and sells packages.

4. Definition of Package Holiday

A package holiday consists of a combination of at least two travel services forming a single journey or holiday, sold under a single contract or a global price, or combined through linked booking processes as defined by Article 33 of the Italian Tourism Code.

5. Precontractual Travel Information

Before concluding the contract, the organiser shall provide all mandatory information regarding travel services, prices, payment terms, minimum participants, documentation requirements, insurance, cancellation rights and traveller assistance.

6. Conclusion of the Package Travel Contract

The contract is concluded upon confirmation by the organiser. Particular requests must be agreed in advance. For contracts concluded away from business premises, the traveller may withdraw within five days unless excluded by law.

7. Payments

At the time of booking, the traveller must pay any applicable administration fees and the deposit specified. The balance must be paid within the contractual deadlines. Failure to pay constitutes an express termination clause.

8. Price

The package price may be increased only under the conditions set out in Article 39 of the Italian Tourism Code and no later than 20 days before departure. Price reductions apply where relevant costs decrease.

9. Amendment or Cancellation Before Departure

If significant changes occur before departure, the traveller may accept the changes or terminate the contract without penalty. Refunds shall be made within fourteen days.

10. Termination by the Traveller

The traveller may terminate the contract before departure subject to reasonable cancellation fees. In cases of unavoidable and extraordinary circumstances, termination may occur without penalty and with full refund.

11. Changes and Transfer of the Package

The traveller may transfer the contract to another person meeting the required conditions, subject to notification and payment of any additional costs incurred.

12. Travellers’ Obligations

Travellers must ensure possession of valid travel documents, comply with destination regulations, exercise due diligence, and inform the organiser of special needs. Failure to comply excludes organiser liability.

13. The Organiser’s Obligations

The organiser is responsible for the proper performance of the package and must remedy non-compliance or provide alternative solutions, price reductions, refunds or repatriation where applicable.

14. Obligations of the Organiser-Seller

The organiser-seller is responsible for correct booking execution and liable for booking system errors, except where caused by the traveller or external circumstances.

15. Compensation Limits

Compensation may be limited except in cases of personal injury or intentional damage, in accordance with Article 43 of the Italian Tourism Code.

16. Local Representative

The traveller may contact a local representative for assistance, complaints or communications relating to the package.

17. Obligation to Provide Assistance

The organiser must provide prompt assistance to travellers in difficulty and may charge reasonable costs only if the difficulty is caused by the traveller.

18. Insurance

Travellers are advised to take out insurance covering cancellation, medical expenses, repatriation and baggage. Insurance rights are exercised directly against insurers.

19. Alternative Dispute Resolution

The organiser may offer alternative dispute resolution procedures pursuant to applicable consumer protection legislation.

20. Traveller Protection

The organiser-seller is covered by insurance or guarantees protecting travellers in case of insolvency or bankruptcy, including refunds and repatriation.

21. Operational Changes

Flight schedules and routes may be subject to change. Travellers should reconfirm services before departure.

22. Data Protection Information

Personal data are processed in compliance with Legislative Decree 196/2003 and EU Regulation 2016/679 (GDPR).

23. Mandatory Legal Information

Italian law punishes crimes concerning prostitution and child pornography, even if committed abroad.
